FOI Act and Data Protection Act

If a person wishes to obtain information about his/herself, then the Data Protection Act 2018 applies and he/she should make a subject Access Request.

If the information is not about the person him/herself, but in relation to a public authority, then the Freedom of Information Act 2002 will apply. The Act gives members of the public a general right of access to 'recorded' information held by public authorities.

For example, if a request is received regarding details of the role and, say, salary paid to a senior post-holder within the institution, this information would probably be released as it relates to the post and not the individual holding the position.
