Tenders may be rejected if they are abnormally low but only after the tenderer has had an opportunity to explain the offer submitted.

If the chosen award criterion is lowest price, and a tender is excluded because it is abnormally low, then this exclusion must be reported to HM Treasury for transmission to the Commission.
